By accessing or using DiegoMetrics ("Service"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

DiegoMetrics provides organisational intelligence diagnostic tools, including the Diego Score assessment, Así framework analysis, and related consulting services.

3. User Accounts

When you create an account, you must provide accurate and complete information. You are responsible for safeguarding your account credentials and for all activities under your account.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorised access to our systems
• Interfere with or disrupt the Service
• Copy, modify, or distribute our content without permission
• Use automated systems to access the Service

5. Intellectual Property

The Diego framework, Así methodology, and all related content, trademarks, and materials are owned by DiegoMetrics. You may not use, reproduce, or distribute our intellectual property without written consent.

Your diagnostic responses and data remain your property, subject to our licence to use this data as described in our Privacy Policy.

6. Diagnostic Results

Diego Scores and recommendations are provided for informational purposes and should not be considered as professional business advice. Results are based on self-reported information and algorithmic analysis.

We make no guarantees about specific outcomes from implementing our recommendations.

7. Payment Terms

Paid services are billed as described at the time of purchase. All payments are non-refundable unless otherwise specified or required by law.

For consulting engagements, payment terms are specified in individual agreements.

8. Limitation of Liability

To the maximum extent permitted by law, DiegoMetrics shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.

Our total liability shall not exceed the amount paid by you for the Service in the 12 months preceding the claim.

9. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

10. Indemnification

You agree to indemnify and hold harmless DiegoMetrics and its affiliates from any claims arising from your use of the Service or violation of these Terms.

11. Termination

We may terminate or suspend your access immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Service will cease immediately.

12. Governing Law

These Terms shall be governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms.
